Dow Applications Policies

Dow has a long history of commitment to the safe and environmentally sound use of chemicals, which we call product stewardship. Dow is a signatory to the Responsible Care Global Charter, an agreement focused on strengthening industry’s commitment to Responsible Care by implementing Responsible Care in their own organizations and leading implementation efforts worldwide, consistent with the Charter elements. The primary objective of Responsible Care (http://www.responsiblecare.org) is to drive continuous industry improvement in environmental, health and safety (EH&S) performance. Product Stewardship supports this objective making health, safety and environmental protection an integral part of product design, manufacture, marketing, distribution, use, recycle and disposal.
Our product stewardship initiatives in all regions reinforce our vision of operating safely and effectively in all of our business practices around the world. Our aim is to work with our value chain partners to sustain their environmental, social and economic success for the long term, by supporting our distributors, resellers, customers, or other direct product receivers in the following manner:
a. Provide health, safety and environmental information.
b. Commensurate with product risk, work to foster proper use, handling, recycling, disposal, and transmittal of appropriate information to downstream users.
c. Take corrective action when improper practices involving a product are discovered, such as ceasing to do business with those who are unwilling to implement these measures.
Chemical distributors and resellers, like you, play a critical role in this process. This is a shared responsibility for minimizing the potential harmful impact throughout all stages of the chemical’s life cycle. Please refer to Dow’s Product Stewardship Expectations (attached) and determine what steps you need to take to ensure the safe and environmentally sound use of chemicals you distribute and resell. Your actions will improve confidence that products are managed safely throughout their lifecycle and help reduce public concerns as a result of increasing expectations from consumers and regulatory authorities.

Dow expects your Company, as our value chain partner, to help us fulfill our commitment by meeting the Product Stewardship expectations below:
- Your Company to timely provide customers with updated Safety Data Sheets (SDS) and up-to-date product information (including but not limited to information regarding safety and health risks, safe handling and correct use, labels and other product literature and any other information legally required to be delivered by suppliers to users of product) so that all foreseeable users will receive the relevant information pertinent to any transportation, operation or application involving Dow’s product. SDS for each product sent or updated must be recorded. Additional copies of product literature will be made available to you upon written request.
- Your Company assesses the safety aspects and environmental impact of product based on tangible information provided by Dow and take appropriate steps while the product is being stored, repackaged and transported to protect persons, property and the environment. Your Company establishes physical facilities, select safe containers and carriers, and perform physical distribution functions consistent with applicable laws and regulations and Dow guidelines.
- Your Company cooperates in inspections, training sessions and meetings which Dow may request in support of the product stewardship obligations referred to in this communication. You instruct and make certain that those of your employees who need to know such information are made aware of and understand information provided by Dow in addition to procedures which are necessary to enable your employees to comply with the requirements of this communication. Further, you shall ensure that these employees are adequately trained to handle emergency situations arising from the transportation, handling and use of Dow product(s).
- Your Company takes reasonable steps to ascertain your customers' operations or applications involving Dow product and will refuse to knowingly sell product into applications or operations which Dow has communicated that it does not support and for other applications which you determine to be unsafe or improper or unlawful. Dow has established Corporate Application Policies & Guidance for Pharmaceutical Development (Active Pharmaceutical Ingredients). Specific businesses have identified certain additional applications which are either restricted for sales or for which an EH&S risk review is required prior to supply. Please consult your Dow Sales Representative should be aware of any such applications or if you have further questions.
- Additionally, you should inform your Dow representative of any potential misuse of Dow products, as well as any environmental, health, or safety incident involving a Dow product that occurs at a customer or your facility (e.g., leaks, spills, employee exposure or injury, allegation of adverse health effect, etc.)
- Your Company understands that Dow product(s) are diverse in nature (both in terms of properties and applications) and may therefore require additional product stewardship requirements. As such, you will comply with any additional requirements that Dow Sales Representative may advise from time to time in respect of these Dow product(s).
Medical Applications Policy
NOTICE REGARDING MEDICAL APPLICATION RESTRICTIONS:
Dow does not support or intend for its products to be used in:
- long-term or permanent contact with internal bodily fluids or tissues. “Long-term” is contact which exceeds 29 calendar days;
- use in cardiac prosthetic devices regardless of the length of time involved (“cardiac prosthetic devices” include, but are not limited to, pacemaker leads and devices, artificial hearts, heart valves, intra-aortic balloons and control systems, and ventricular bypass-assisted devices);
- use as a critical component in medical devices that support or sustain human life; or
- use specifically by pregnant women or in applications designed specifically to promote or interfere with human reproduction.
- use as an ingredient of a pharmaceutical injectable application.
Dow requests that customers considering use of Dow products in medical applications notify Dow so that appropriate assessments may be conducted. Dow does not endorse or claim suitability of its products for specific medical applications. It is the responsibility of the medical device or pharmaceutical manufacturer to determine that the Dow product is safe, lawful, and technically suitable for the intended use.
DOW MAKES NO WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE SUITABILITY OF ANY DOW PRODUCT FOR USE IN MEDICAL APPLICATIONS.
Dow does not support or intend for its products to be used, directly or indirectly, in the production of tobacco, the manufacture of tobacco products, the manufacture and use of electronic cigarettes/vaping, the production of marijuana, or the manufacture of marijuana products intended for human consumption, where the Dow product (or its residues) may be present in the finished product or be alleged to facilitate the delivery of nicotine, other tobacco components, marijuana, or marijuana components.
The Dow Chemical Company, including subsidiaries and controlled affiliates (together and individually hereinafter referred to as “Dow”), will not knowingly and voluntarily sell, directly or indirectly, any new or existing Dow product into applications specifically intended to harm human beings where the Dow product is an active ingredient or critical enabler in the destructive component of the final product or application (“Intentionally Harmful Applications”).
